Please read these terms carefully before submitting a listing on our platform.

Important Notice: By submitting a horse listing on this platform, you confirm that you have read and agree to the terms and conditions set out below. These terms form a binding agreement between you (the Seller) and We Buy Horses.

1. Agreement to Terms

By submitting a horse listing on the We Buy Horses platform ("the Platform"), you ("the Seller") confirm that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree to these terms, you must not submit a listing.

2. Accuracy of Listing Information

The Seller warrants that all information provided in the listing — including but not limited to the horse's name, breed, age, gender, height, health status, temperament, training level, and asking price — is accurate, truthful, and not misleading. The Seller accepts full liability for any inaccuracies, misrepresentations, or omissions in the listing.

3. Ownership & Authority to Sell

The Seller confirms that they are the lawful owner of the horse, or are otherwise authorised to sell the horse on behalf of the owner. The Seller warrants that the horse is free from any encumbrances, liens, or third-party claims that would prevent or restrict the sale.

4. Commission

The Seller agrees to pay We Buy Horses a commission of 8% (eight percent) of the final agreed sale price upon completion of a sale facilitated through the Platform. This commission is due and payable at the time of sale finalisation. The Seller will receive the remaining amount after commission has been deducted.

5. Listing Upgrade Fees

The Platform offers two optional paid listing upgrades: • Featured Listing — R399 (three hundred and ninety-nine rand): The Seller's listing is pinned at the top of the homepage, promoted on the Platform's social media pages, and displayed with a Featured badge for maximum exposure. • Sell Your Horse Fast — R499 (four hundred and ninety-nine rand): Includes all Featured Listing benefits, plus active marketing directly to prospective buyers, listing in the buyer WhatsApp group, Facebook advertising and social media targeting, and priority network marketing for higher visibility. Both upgrade fees are payable upfront via the Platform's payment gateway and are strictly non-refundable, regardless of whether the horse is subsequently sold through the Platform.

6. Buyer Deposit

When a buyer pays a holding deposit to secure a horse, the Seller agrees to remove the horse from active marketing for a reasonable period to allow the transaction to be completed. The Seller may not accept alternative offers during this period without first notifying We Buy Horses.

7. Platform Role & Liability

We Buy Horses acts solely as an intermediary marketplace facilitating the connection between buyers and sellers. We Buy Horses is not a party to any sale agreement between the Seller and Buyer and accepts no liability for disputes, losses, or damages arising from any transaction. All sales are conducted directly between the Seller and Buyer at their own risk.

8. Prohibited Listings

The Seller may not list horses that are stolen, subject to legal proceedings, or that the Seller does not have the right to sell. We Buy Horses reserves the right to remove any listing and suspend any account that is found to be in violation of these terms or applicable law.

9. Health & Veterinary Disclosure

The Seller is encouraged to disclose any known health conditions, injuries, or veterinary history relevant to the horse. Failure to disclose material health information may constitute misrepresentation and could expose the Seller to legal liability. We Buy Horses strongly recommends that buyers commission a pre-purchase veterinary examination.

10. Platform Rights

By submitting a listing and its associated images and descriptions, the Seller grants We Buy Horses a non-exclusive, royalty-free licence to display, promote, and share the listing content on the Platform and associated social media channels for the purpose of marketing the horse.

11. Banking Details & Payment Responsibility

The Seller is solely responsible for providing accurate and complete banking details at the time of listing. We Buy Horses will process seller payouts exclusively to the banking details provided by the Seller on the Platform. In the event that incorrect, incomplete, or fraudulent banking details are submitted, We Buy Horses accepts no liability whatsoever for any failed, misdirected, or lost payments. It is the Seller's responsibility to ensure that all banking information is correct before submitting a listing. We Buy Horses will not be held responsible for any financial loss arising from errors in the banking details provided.

12. Amendments

We Buy Horses reserves the right to amend these Terms and Conditions at any time. Continued use of the Platform after such changes constitutes acceptance of the updated terms. It is the Seller's responsibility to review the terms periodically.

13. VAT

All prices displayed on the Platform exclude VAT. VAT is currently not applicable.

14. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the jurisdiction of the South African courts.

15. Transfer of Risk

Risk in and to the horse shall pass to the Buyer upon payment of the purchase price or deposit. From that moment, the Seller shall not be liable for any injury, illness, loss, or death of the horse, howsoever caused. It is strongly recommended that the Buyer arranges appropriate insurance coverage for the horse from the time of payment.

16. Full Payment & Finality of Sale

Once full payment for a horse has been completed, the sale is final and non-refundable. The Buyer acknowledges that they have had a reasonable opportunity to inspect the horse and satisfy themselves as to its condition prior to completing payment. A refund may only be considered in the following circumstances: • Proven misrepresentation by the Seller — where the Seller has knowingly provided false or materially misleading information about the horse in the listing or during the sale process; or • Failed pre-purchase veterinary examination — where the Buyer and Seller have mutually agreed in writing, prior to the sale, that the sale is conditional upon the horse passing a veterinary examination, and the horse subsequently fails that examination. In either of the above circumstances, the Seller shall be liable to refund the Buyer in full. We Buy Horses accepts no liability for any refund disputes and will not be responsible for facilitating or funding any refunds between Buyers and Sellers.
